Each legal person must be designated by a name that differs from that of any other legal person.
If the name is identical to another, or if the similarity may be misleading, any interested party may have it amended and claim damages, if any.
A legal person may not use in its name or otherwise any legal form other than that which it has validly adopted. In the event of non-compliance with this rule, any interested party may apply to the court of the company where the legal person has its registered office for an order to cease such use.
Notwithstanding any provision to the contrary, the founders of a company, or in the event of a subsequent change in the name, the members of the administrative organ shall be jointly and severally liable to the persons concerned for damages.
